These Regulations define the basic rules of operation of the website https://miranpack.com (hereinafter referred to as the " Website ").

  1. The owner of the website https://miranpack.com is MIRAN.PL SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ with its registered office in Warsaw, registered address: ul. Mikołaja Kopernika 5, premises LU8, 00-367 Warsaw, a company incorporated under Polish law, entered into the Register of Entrepreneurs of the National Court Register kept by the District Court for the capital city of Warsaw in Warsaw, 12th Commercial Division of the National Court Register under number 0000917992, with NIP number : 973 -040-85-92 and REGON: 978073378, share capital PLN 50,000, fully paid up, hereinafter referred to as " PL ",
  2. PL does not provide electronic services within the meaning of the Act of 18 July 2002 on the provision of electronic services (Polish Journal of Laws No. 144, pos. 1204), the Website does not allow direct or indirect conclusion of contracts, submitting offers, binding declarations of will or placing orders, therefore MIRAN.PL is not obliged to draw up the regulations in accordance with the provisions of this Act.
  3. The website is only informative about the activities of MIRAN.PL, the general range of services and goods offered, or indicative prices, and allows entities intending to obtain an offer for MIRAN.PL services or goods to establish first contact via the contact form provided on the Website.
  4. The purpose of the Website is to provide visitors with a registered office or place of residence in the European Economic Area with information about the scope of MIRAN.PL's activity, basic information about the goods and services sold by MIRAN.PL, and to enable initial contact with those visitors who are interested in are the beginning of economic cooperation with MIRAN.PL. The terms of this cooperation are agreed by the visitor with MIRAN.PL outside the Website, by way of an exchange of declarations of will, in a "classic" manner, provided for by the standards of the general part of the Polish Civil Code.
  5. The Website does not have functionalities that allow you to set up user accounts or handle electronic payments.
  6. The Website is not an online store or any other platform for ordering services or goods electronically.
  7. The use of its functionalities by visitors to the Website, including the use of the contact form, does not lead to binding the visitor with MIRAN.PL with a contract or any other legal relationship.
  8. PL processes visitors' personal data and uses cookies, which results in a legal obligation to define the processing framework. In the scope of fulfillment by MIRAN.PL of the obligations resulting from the provisions on the protection of personal data, a separate information was prepared - the Privacy Policy, constituting an integral appendix to the Regulations.
  9. Due to the impossibility of concluding, as part of using the Website, an agreement electronically, MIRAN.PL does not provide a model withdrawal from such an agreement.
  10. In the event that the Website was to start serving the purposes of an online store or other platform for the provision of electronic services, MIRAN.PL will amend these Regulations in order to ensure its compliance with the Act of 18 July 2002 on the provision of electronic services (Polish Journal of Laws No. 144, pos. 1204).

    (hereinafter referred to as the "Privacy Policy")


    This Privacy Policy implements the information obligations imposed by the law, the website owner - data administrator in relation to the principles of personal data processing, i.e. the requirements resulting from:

    • Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) of April 27, 2016 (Journal of Laws UE.L No. 119, p. 1), hereinafter referred to as " GDPR ",
    • the Personal Data Protection Act of May 10, 2018 (Polish Journal of Laws of 2018, item 1000), hereinafter referred to as the " ODO Act ",
    • the Act of 18 July 2002 on the provision of electronic services (Polish Journal of Laws No. 144, item 1204), hereinafter referred to as the " UDE Act ".


    PART I - General Information:

    1. The administrator of personal data provided by visitors via the website https://miranpack.com is MIRAN.PL SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ with its registered office in Warsaw, registered address: ul. Mikołaja Kopernika 5, premises LU8, 00-367 Warsaw, a company incorporated under Polish law, entered into the Register of Entrepreneurs of the National Court Register kept by the District Court for the capital city of Warsaw in Warsaw, 12th Commercial Division of the National Court Register under number 0000917992, with NIP number : 973 -040-85-92 and REGON: 978073378, share capital PLN 50,000, fully paid up, hereinafter referred to as " MIRAN.PL ",
    2. MIRAN.PL is entitled to disclose personal data only to authorized entities, in accordance with the provisions of this Privacy Policy or the regulations (hereinafter referred to as the " Regulations ") of the website https://miranpack.com (hereinafter referred to as the " Website ") and when the obligation to disclose them results from the mandatory provisions of the generally applicable law of the Republic of Poland or directly applicable mandatory standards of European or international law,
    3. MIRAN.PL obtains personal data directly from users of the Website by voluntarily completing the contact form and from all visitors to the Website in the scope of data collected automatically (hereinafter jointly referred to as "Contacting Persons").
    4. The personal data of the Contacting Persons are processed only to the extent permitted by and on the terms set out in the GDPR, the ODO Act and other currently applicable standards of generally applicable law,
    5. Using the Website is possible only after reading the provisions of the Regulations,
    6. MIRAN.PL does not allow the creation of user accounts, MIRAN.PL also does not provide electronic services within the meaning of the UDE Act, the Website is only a source of information about the activities of MIRAN.PL and enables a convenient form of contact for Contacting Persons - the contact form.

     

    PART II - Purpose of data processing of the Contacting Persons:

    1. The Privacy Policy specifies the actions taken by MIRAN.PL in the field of protection of personal data processed, including those collected via the Website and related activities of the Contacting Persons, i.e. sending information using the contact form,
    2. MIRAN.PL processes the personal data of the Contacting Persons in order to ensure the functionality of the Website in accordance with its Regulations, to establish contact with the Contacting Person as well as to solve technical problems,
    3. MIRAN.PL processes personal data obtained from the Contacting Persons, which they entered into the content of the contact form,
    4. the contact form does not contain fields for indicating sensitive data, the Contacting Person should not indicate such data, they are not necessary to contact MIRAN.PL and thus are not necessary to achieve the purposes of the Regulations,
    5. MIRAN.PL processes the personal data of the Contacting Persons also for its own marketing purposes, in particular promoting services by presenting the Contacting Persons with offers, discounts or promotions tailored to their interests. In the scope of abovementioned purpose  MIRAN.PL performs profiling activities. Profiling by MIRAN.PL does not affect the rights or duties of the Contacting Persons.
    6. MIRAN.PL also processes the personal data of the Contacting Persons for the following purposes:
      1. conducting research and analysis of the Website, including in terms of the functioning of the Website, improvement of operation or estimation of the main interests and needs of the Contacting Persons,
      2. ensuring the safety of using the Website, including enforcing compliance with the Regulations and counteracting possible illegal activities of third parties, e.g. fraud and abuse,
      3. performance of obligations arising from the provisions of generally applicable law.
    7. MIRAN.PL does not use the obtained personal data to send general and non-personalized newsletters.


    PART III - Scope of processing personal data of Contacting Persons:

    1. MIRAN.PL processes the following personal data of Contacting Persons via the Website:
      1. Contact details: establishing cooperation by MIRAN.PL with the Contacting Person may require him to provide information identifying the Contacting Person in the content of the contact form. This data may include, for example, e-mail address, registration address or telephone number. The Contacting Person may also enter other data in the content of the form, for example: name, surname, company, address, registered office, telephone number or registration numbers (tax number or personal identification number, for entities from Poland, respectively NIP and PESEL or KRS, and for entities from European Economic Area, corresponding numbers assigned in other countries),
      2. Contact form: MIRAN.PL by using the Website may collect personal data of Contacting Persons with MIRAN.PL using the Website's functionality - the contact form. These data are necessary to enable MIRAN.PL to contact the Contacting Persons for purposes directly related to the operation of the Website and potential economic and commercial cooperation. The provided contact form is not used for private correspondence not related to the use of the Website and the business activity of MIRAN.PL. Counteracting, in accordance with generally applicable law, unfair practices and other violations of the law, entitles MIRAN.PL to collect data regarding communication made via the above-mentioned contact form for the implementation of these purposes,
      3. Data collected by the website in the browser (personal computers and mobile devices): When it is necessary to make contact with the Contacting Person or when it is a legitimate interest of MIRAN.PL or third parties, MIRAN.PL is entitled to automatically obtain and record data transferred to server via web browsers or devices of the Contacting Persons. Such data may include, for example, the IP address (the address used by the Contacting Person’s device used to access the Website), the parameters of the software and hardware used by the Contacting Persons, pages viewed in terms of subpages of the Website, mobile device identification number, as well as information on the use of from the application, a unique RegID and other data on devices and the use of systems, as well as information on how the Contacting Person uses the Website (if the Contacting Person agrees to cookies),
      4. Supplementing data: MIRAN.PL is entitled to supplement the information it has about the Contacting Person, with data obtained in accordance with the law from third parties and on the basis of consents granted by the Contacting Person,
      5. Promotional campaigns and contests: MIRAN.PL may organize promotional campaigns and contests (as well as conduct other activities of a similar nature). Personal data of the Contacting Persons (e.g. data necessary for contact) who will take part in the contest or campaign may be used by MIRAN.PL for the efficient conduct of the contest, for example to notify the Contacting Person of the victory, etc.
    2. Information provided by the Contacting Persons in the opinions on websites not belonging to MIRAN.PL (e.g. Google) is not collected by MIRAN.PL. For this reason, MIRAN.PL is not responsible for the information provided by the Contacting Persons as part of such opinions.


    PART IV - Time of personal data processing:

    The period during which MIRAN.PL processes the Contacting Persons' personal data for the entire period of the Contacting Person's stay with MIRAN.PL in the process of negotiations, talks and answering questions - until the consent is withdrawn, and then for the period of limitation of claims, but not longer than for a period of six years.


    PART V - Recipients of personal data:

    1. MIRAN.PL transfers personal data of the Contacting Persons only when it is necessary to achieve the objectives and/or purposes of the activities agreed in the process of contacting with the Contacting Persons. Their personal data may be transferred to the following trusted partners by MIRAN.PL:
      1. Entrepreneurs providing database software delivery and maintenance services;
      2. entities providing accounting services for MIRAN.PL
      3. entities providing other services necessary to perform activities agreed with the Contacting Person (if such activities are agreed).
    2. Only the data that is necessary for the achievement of specific purposes is transferred. In order to protect the personal data of the Contacting Persons as far as possible, MIRAN.PL uses (if possible and necessary) anonymization or pseudonymization tools.
    3. MIRAN.PL does not provide third parties with personal data of the Contacting Persons without their consent. However, MIRAN.PL may disclose personal data of the Contacting Person to public authorities, including in connection with ongoing proceedings regarding possible violations of the law or preventing other possible violations of the Regulations.
    4. MIRAN.PL undertakes not to sell personal data of the Contacting Persons.
    5. In justified cases, MIRAN.PL may disclose the last IP address of the Contacting Person.
    6. MIRAN.PL may share anonymized data to third parties in order to better the attractiveness of advertisements and improve the methods of doing business activity.
    7. MIRAN.PL does not sell personal data of the Contacting Persons or make them commercially available to third parties.
    8. The Contacting Person may be redirected to websites belonging to third parties and thus beyond the control of MIRAN.PL, where the processing of personal data is carried out in accordance with the rules set out by these entities.


    PART VI - Method of data processing:

    1. MIRAN.PL processes the personal data of the Contacting Persons in accordance with applicable law, in particular in accordance with the provisions of the ODO Act and in accordance with the GDPR.
    2. MIRAN.PL is guided by the following general principles when processing personal data of the Contacting Persons:
      1. The adequacy rule: Only the data that is necessary to achieve a given processing purpose is processed,
      2. The principle of transparency: The Contacting Person has the right to have full knowledge of what is happening with his personal data,
      3. The rule of correctness: MIRAN.PL makes efforts to ensure that the personal data of the Contacting Persons processed on the Website is up-to-date and truthful,
      4. The rule of integrity and confidentiality: MIRAN.PL applies the necessary measures to protect the confidentiality and integrity of personal data. This protection include physical and technological measures limiting access to personal data and securing personal data against loss,
      5. Accountability rule: MIRAN.PL strives in its activities to enable accounting for each action performed on personal data.


    PART VII - Types of consents collected:

    1. MIRAN.PL collects the following consents from the Contacting Persons:
      1. consent to communicate by e-mail or telephone for the purposes of negotiations or establishing cooperation - it includes consent to informing about new products, offers, discounts as well as competitions and promotional campaigns. This consent can be expressed as part of a statement under the contact form on the Website,
      2. consent to the cookie policy.
    2. Expressing consent is voluntary and does not make the Contacting Person’s ability to use the Website
    3. Each person who has given consent has the right to withdraw it at any time by contacting via e-mail to the following address: miranpack@miranpack.com or by post to the delivery address MIRAN.PL
    4. MIRAN.PL informs that it will make efforts to ensure that the activities related to the withdrawal of consent take place without undue delay, no longer than one month from the date of receipt of the statement of consent withdrawal. Withdrawal of consent does not affect the lawfulness of the processing that was made on the basis of consent before its withdrawal.


    PART VIII - Rights of persons whose data is processed:

    1. The Contacting Person may exercise the following rights to the protection of personal data in relation to MIRAN.PL, which result from the GDPR:
    • Right to information: In a transparent manner, using simple and concise language, MIRAN.PL will inform the Contacting Person about:
      1. the purposes and legal basis of processing his personal data,
      2. the period of processing his personal data,
      3. the possibility of profiling and raising objections,
      4. his rights: i.e. the right to access personal data and receive a copy thereof, the right to rectify, delete data, the right to object, the right to withdraw consent at any time, the right to lodge a complaint with the supervisory authority,
    • The right to access the content of their personal data: The Contacting Person may request MIRAN.PL to export information about the Contacting Person’s personal data from the databases. The Contacting Person has the right to access their data processed by MIRAN.PL, after verifying the identity of the requesting party.
    • The right to correct data: If the Contacting Person receives information that the data processed by MIRAN.PL is incorrect, the Contacting Person has the right to request their correction, and MIRAN.PL will be obliged to apply the corrections after prior verification of the accuracy of the data,
    • Right to limit data processing: If, despite complying by MIRAN.PL with the adequacy rule, the Contacting Person considers that MIRAN.PL processes too much data, he has the right to request MIRAN.PL to limit this scope of processing. At the request of the Contacting Person, MIRAN.PL will limit the processing of data only to their storage. MIRAN.PL will then stop other data processing activities, e.g. sharing them.
    • Right to request deletion of data: This right, also known as the right to be forgotten, means the right of the Contacting Person to request that MIRAN.PL remove from database systems and other documentation any information containing personal data of the Contacting Person . This does not apply if there is an obligation to further process this data on the basis of legal provisions. In each case, however, MIRAN.PL will remove personal data to the fullest possible extent, and where this is not possible, it will ensure their pseudonymization, thanks to which the contacting data that must be retained will be available only to a very limited group of people. The Contacting Person has the right to request MIRAN.PL to delete their data. However, if MIRAN.PL is (or will be) obliged by law (including a ruling or decision) to further process the Contacting Person's personal data, it will inform him about it,
    • The right to transfer data to another data administrator: The Contacting Person may request MIRAN.PL to export the data provided in the course of all contacts to a separate file for further transfer to another data administrator. At the request of the Contacting Person, within a month of receiving the request, he will receive from MIRAN.PL a file with data in the commonly used .csv format. Under this right, the Contacting Person may also indicate the entity to which MIRAN.PL is to send its personal data.
    • Right to object to data profiling: The Contacting Person may exercise the right to object to data profiling, he should notify MIRAN.PL of this fact to the e-mail address: miranpack@miranpack.com
    1. Some third parties that provide their services on the Website allow Contacting Persons to choose whether to withdraw consent to the collection and use of data by them for the purposes of advertising based on their activity.
    2. Cookies: Most of the known browsers for personal computers and mobile devices (e.g. Safari, Firefox, Internet Explorer, Chrome, Opera, Microsoft Edge) provide the option of limiting or blocking the use of cookies in the contacting system.
    3. If the Contacting Person decides that MIRAN.PL has in any way violated the rules of processing his personal data, he has the right to submit a complaint directly to the supervisory authority - the President of the Office for Personal Data Protection. As part of exercising this right, the Contacting Person should provide a full description of the situation along with an indication of what action it considers to be violating its rights or freedoms.
    4. The implementation of the rights of the Contacting Person is, in principle, free of charge. The Contacting Person will not have to pay a fee for exercising the right to access their personal data (or for exercising any other rights). However, MIRAN.PL may charge a fee in a reasonable amount if the request of the Contacting Person is manifestly unjustified or excessive, in particular due to their continuous (and also repetitive) nature. In such cases, MIRAN.PL may also refuse to comply with the request of the Contacting Person.
    5. MIRAN.PL makes maximum efforts to respond to all legally justified requests within one month from the date of receipt of the Contacting Person's request. If the Contacting Person's request is particularly complex or it has made several requests, it may take more than a month to recognize them. In this case, MIRAN.PL will inform about the extension of the deadline and provide current information on the execution of the request.


    PART IX - Safety:

    1. All data collected by MIRAN.PL (including personal data) are protected using the necessary technical and organizational measures and security procedures to protect them against unauthorized access or unauthorized use. Entities related to MIRAN.PL, trusted partners and other service providers are obliged to manage personal data in accordance with the security and privacy protection requirements adopted by MIRAN.PL.
    2. All information that MIRAN.PL receives is stored only on properly secured servers. MIRAN.PL has also implemented appropriate and necessary technical and organizational measures to protect personal data.
    3. MIRAN.PL constantly assesses the level of security within its network and monitors internal regulations and procedures designed to protect personal data against accidental or unlawful loss, access or disclosure.
    4. MIRAN.PL identifies foreseeable risks and threats to network security and minimizes them, including through risk assessment and regular tests.
    5. The information available on the Website is not directed to minors under 16 years of age and MIRAN.PL knowingly does not collect information about them. If MIRAN.PL discovers that a person under the age of 16 has provided their personal data, it will delete it immediately.


    PART XI - Change of provisions

    1. The Privacy Policy may be changed or updated by MIRAN.PL.
    2. Any changes will be posted on the website https://miranpack.com.
    3.     This information is an integral part of the Privacy Policy of the Website (miranpack.com). The website does not automatically collect any information other than that contained in cookies.


    PART I - General information

    1. The cookies policy defines the rules for storing and accessing information on the Contacting devices using cookies, used for the functioning of the Website, run by MIRAN.PL.
    2. Definitions:
      1. Administrator - means an entrepreneur - MIRAN.PL, which stores and accesses information on the Contacting Persons’ devices,
      2. Cookies - mean IT data, in particular small text files, saved and stored on the Contacting Persons’ Devices through which they use the Website;
      3. Administrator's Cookies - means cookies placed by the Administrator, related to the Administrator's operation of the Website,
      4. External Cookies - means cookies placed by the Administrator's partners via the Website,
      5. Website - means the website under which the Administrator runs a website operating in the domain https://miranpack.com (as defined in the main part of the Privacy Policy),
      6. Device - means an electronic device through which the Contacting Person gains access to the Website;
      7. Contacting Person - means an entity using the Website in accordance with the Regulations and the Privacy Policy
    3. Obtaining and storing information using cookies is possible on the basis of the consent of the Contacting Person. By default, web browsers or other software installed on a computer or other device connected to the Internet allow cookies to be placed on such a Device by default, and thus to collect information about the Contacting Person. In the web browser settings, the consent given to the use of cookies may be modified or revoked at any time. Withdrawal of consent does not affect the lawfulness of the processing that was made on the basis of consent before its withdrawal.
    4. As for Contacting Persons, the Website uses cookies to identify the browser or device. Cookies collect various types of information that, as a rule, do not constitute personal data. However, some information, depending on their content and how they are used, may be associated with a specific person and thus be considered personal data. These data are encrypted, which prevents access by unauthorized persons.


    PART II - Types of cookies used:

    1. The cookies used by the Administrator are safe for Devices. In particular, it is not possible to get viruses or other unwanted software or malware to the Devices this way. These files allow to identify the software used by the Contacting Person and adapt the Website individually to each Contacting Person. Cookies usually contain the name of the domain they come from, their storage time on the Device and the assigned value.
    2. The Administrator uses the following types of cookies:
      1. session cookies: they are stored on the Device and remain there until the end of the browser session. The saved information is then permanently deleted from the Device's memory. The session cookie mechanism does not allow you to download any personal data or any confidential information from the Device. The information obtained through the use of this type of cookies helps to analyze network traffic, identify and solve technical problems and enable easier navigation on the Website,

MIRAN.PL has no influence on third party websites and is not responsible for the cookies they collect or access.     PART III - Purposes for which cookies are used:

    1. The Administrator uses the Administrator's cookies for the following purposes:

    1. Using cookies and Google Analytics used on the website https://mirnapack.com, it is possible to learn about the preferences of the Contacting Person (profiling). Analysis of behavior on the Website allows you to understand habits and expectations and adapt them to your needs and interests. Thanks to this, it is possible not only to present advertisements tailored to preferences, but also to create and present tailored offers or discounts not available to other people.
    2. Third parties, such as advertising networks and external service providers, dealing with e.g. web traffic analysis, may use cookies and software development kits (SDKs) or other related technologies to collect information about Contacting Persons visits to the Website.
